HyperRep LLC (“HyperRep,” “we,” “us,” or “our”) provides software for customer communications, sales workflows, CRM, quoting, automation, analytics, and related business operations.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you access or use HyperRep’s websites, applications, portals, APIs, communications, and related services that link to or reference this Privacy Policy (collectively, the “Services”).

HyperRep provides services primarily to businesses and organizations. In some contexts, we process personal information for our own business purposes, such as operating our websites, managing customer accounts, providing support, and improving our Services. In other contexts, we process personal information on behalf of our customers, including information about their leads, contacts, end customers, users, and other individuals who interact with HyperRep-powered workflows.

HyperRep does not sell personal information. HyperRep does not store full payment card numbers. HyperRep uses artificial intelligence and automation to provide the Services, as described in this Privacy Policy.

1. Scope

This Privacy Policy applies to personal information we process about:

  • visitors to our websites;
  • customers, prospective customers, and their authorized users;
  • individuals who interact with HyperRep-powered communications, portals, forms, chat, phone, email, SMS, quote workflows, or other features; and
  • other individuals who communicate with us or use the Services.

This Privacy Policy does not apply to third-party websites, applications, products, or services that HyperRep does not control.

2. Our Role

HyperRep may process personal information in different roles depending on the context.

HyperRep as a Controller

We act as a controller when we determine how and why personal information is processed for our own business purposes. This includes operating our websites, managing customer accounts, marketing the Services, providing support, securing our systems, and managing business operations.

HyperRep as a Processor or Service Provider

We act as a processor or service provider when we process personal information on behalf of our business customers. This commonly includes information about our customers’ leads, contacts, end customers, users, account holders, and other individuals who interact with HyperRep-powered workflows.

When we process personal information on behalf of a customer, the customer is generally responsible for determining how that information is collected, used, disclosed, and retained. Our processing is governed by our agreement with that customer, including any applicable data processing addendum or similar agreement.

3. Personal Information We Collect

The personal information we collect depends on your relationship with HyperRep and how you use or interact with the Services.

Information You Provide

We may collect information you provide directly, including name, email address, phone number, company or organization, job title or role, account information, support requests, sales inquiries, marketing preferences, files, documents, signatures, quote materials, form submissions, messages, and other information you choose to provide.

Customer Account and Business Data

For customers and authorized users, we may process account, CRM, sales, pricing, quoting, workflow, usage, authentication, integration, knowledge base, audit log, and related business data. This may include information about customer configurations, users, permissions, conversations, service history, sales activity, and operational workflows.

End-Customer, Lead, and Contact Data

When individuals interact with a HyperRep-powered experience on behalf of one of our customers, we may process information such as names, contact details, addresses or service locations, quote requests, service requests, order information, invoice or account status, job details, portal activity, chat transcripts, emails, SMS messages, phone call transcripts or metadata, customer-provided recordings, attachments, signed documents, and other information submitted through or connected to the Services.

Information Collected Automatically

We and our service providers may automatically collect information such as IP address, device and browser information, operating system, referring URLs, pages viewed, links clicked, session activity, approximate location derived from IP address, timestamps, authentication events, usage data, error logs, performance data, and security logs.

We may collect this information through cookies, local storage, pixels, software development kits, logs, and similar technologies.

Information from Third Parties and Integrations

We may receive personal information from customers, authorized users, end customers, business partners, communications providers, payment processors, authentication providers, analytics and monitoring providers, CRM systems, email or productivity platforms, customer support tools, connected integrations, publicly available sources, and other third parties.

4. Sensitive Personal Information

HyperRep does not intentionally collect sensitive personal information such as health information, government identification numbers, precise GPS location, biometric data, children’s data, or financial account numbers, unless such information is submitted through the Services by a customer, user, or other individual.

You should not submit sensitive personal information to HyperRep unless it is necessary for use of the Services and you are authorized to provide it.

HyperRep does not store full payment card numbers.

5. How We Use Personal Information

We use personal information to provide, operate, secure, improve, and support the Services and our business. This includes using personal information to:

  • create, manage, and authenticate accounts;
  • provide websites, applications, portals, APIs, and customer workflows;
  • support communications by email, phone, chat, SMS, forms, portals, and related channels;
  • provide CRM, quoting, sales, service, analytics, reporting, and automation features;
  • generate, classify, summarize, route, analyze, and manage communications;
  • process signed documents and related metadata;
  • support integrations and connected systems;
  • troubleshoot errors and monitor performance;
  • provide customer support;
  • send administrative, transactional, security, and service-related communications;
  • send marketing communications where permitted;
  • improve product functionality, reliability, quality, and security;
  • detect, investigate, and prevent fraud, abuse, misuse, unauthorized access, and security incidents;
  • enforce agreements and policies;
  • comply with legal obligations;
  • maintain audit, compliance, and business records; and
  • support business operations, planning, reporting, and corporate transactions.

6. Artificial Intelligence and Automated Processing

HyperRep uses artificial intelligence, machine learning, and automated systems to provide and improve the Services.

These systems may be used to classify communications, summarize conversations, draft responses, generate suggested replies, route inquiries, identify customer intent, extract structured information, support quoting and sales workflows, assist with accounts receivable workflows, and produce other outputs related to customer communications and business operations.

Some HyperRep features may generate or send communications automatically. Other features may require human review or approval depending on customer configuration.

HyperRep does not use customer data or end-customer data to train third-party foundation models unless expressly agreed with the applicable customer or otherwise permitted by law and contract.

AI-generated outputs may be inaccurate, incomplete, or require review. Customers are responsible for configuring and using the Services appropriately for their business, legal, and operational needs.

7. How We Disclose Personal Information

We may disclose personal information as described below.

Customers and Authorized Users

When we process information on behalf of a customer, we may disclose that information to the customer and its authorized users, administrators, personnel, systems, and integrations.

Service Providers and Subprocessors

We may disclose personal information to vendors, service providers, and subprocessors that help us provide, secure, monitor, support, and improve the Services. These may include providers of cloud infrastructure, databases, communications, AI infrastructure, analytics, monitoring, error tracking, payment processing, authentication, security, document processing, support, and business operations services.

These providers are authorized to process personal information only as necessary to provide services to us or as otherwise permitted by law and contract.

Customer-Directed Integrations and Third Parties

Customers may connect the Services to third-party systems or direct us to disclose information to third parties. We are not responsible for the privacy practices of third parties that customers choose to use, connect, or authorize.

Legal, Security, and Compliance

We may disclose personal information if we believe disclosure is necessary or appropriate to comply with law, legal process, or governmental requests; enforce agreements; protect the Services; prevent fraud, abuse, or security incidents; protect rights, safety, or property; or establish, exercise, or defend legal claims.

Business Transfers

We may disclose or transfer personal information in connection with an actual or potential merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar corporate transaction.

Consent or Direction

We may disclose personal information with consent or at the direction of the relevant individual or customer.

8. No Sale or Sharing of Personal Information

HyperRep does not sell personal information.

HyperRep does not knowingly share personal information for cross-context behavioral advertising as that term is used under certain U.S. state privacy laws.

If our practices change, we will update this Privacy Policy and provide any legally required notices and choices.

9. Cookies and Similar Technologies

We and our service providers use cookies, local storage, pixels, analytics tools, logs, and similar technologies to operate the Services, keep users logged in, remember preferences, secure accounts, analyze usage, measure marketing performance, detect errors, monitor performance, and improve the Services.

You can control cookies through your browser settings. If you disable cookies, some features may not function properly.

We may provide additional cookie information in a separate Cookie Notice or preference center.

10. Payments

HyperRep does not store full payment card numbers. Payment processing is handled by third-party payment processors, which process payment information according to their own privacy policies and legal obligations.

HyperRep may process related billing, invoice, quote, transaction status, payment status, account balance, and administrative information as necessary to provide the Services and support customer workflows.

11. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, operate our business, comply with legal obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, support audit and compliance needs, and fulfill the purposes described in this Privacy Policy.

Retention periods may vary depending on the type of information, customer configuration, contractual obligations, legal requirements, backup practices, and operational needs.

When we process personal information on behalf of a customer, we retain and delete that information according to our agreement with the customer and the customer’s instructions, subject to applicable law and legitimate business needs.

We may retain de-identified, aggregated, or anonymized information for lawful business purposes.

12. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure.

These safeguards may include encryption in transit, access controls, authentication controls, role-based permissions, logging and monitoring, network and infrastructure security measures, secure development practices, vendor review, backup and recovery procedures, and internal policies and procedures.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Data Processing Addendum

For business customers, HyperRep may make a data processing addendum or similar agreement available where appropriate. A data processing addendum may include additional terms related to confidentiality, security, subprocessors, data subject requests, deletion, return of data, and international transfers.

If there is a conflict between this Privacy Policy and a written agreement between HyperRep and a customer, the written agreement controls to the extent of the conflict.

14. Subprocessors

HyperRep uses third-party service providers and subprocessors to help provide the Services. The categories of subprocessors we use may include cloud infrastructure providers, database providers, communications providers, AI infrastructure providers, analytics providers, monitoring providers, payment processors, authentication providers, security providers, document processing providers, and business operations providers.

We may update our subprocessors from time to time. Where required by law or contract, we will provide notice of subprocessor changes or make additional subprocessor information available.

15. Your Privacy Rights and Choices

Depending on where you live and how you interact with HyperRep, you may have rights regarding your personal information. These may include the right to request access, correction, deletion, portability, restriction, objection, withdrawal of consent, or an appeal of our decision regarding a privacy request.

You may also have the right to opt out of certain sales, sharing, targeted advertising, or profiling. HyperRep does not sell personal information and does not knowingly share personal information for cross-context behavioral advertising.

We may need to verify your identity before fulfilling a request. We may deny or limit requests where permitted by law, including where we need to retain information for security, legal, contractual, operational, or compliance reasons.

If we process your personal information on behalf of one of our customers, we may refer your request to that customer or assist the customer in responding, depending on the nature of the request and our legal obligations.

You may opt out of marketing emails by using the unsubscribe link in the email or contacting us at [email protected]. We may still send transactional, administrative, security, or service-related messages.

We may collect personal information from you, our customers, authorized users, end customers, leads, contacts, integrations, service providers, communications providers, analytics and monitoring tools, business partners, and publicly available sources.

Purposes

We collect and use personal information for the purposes described in this Privacy Policy, including to provide the Services, support customer workflows, operate our business, communicate with you, improve the Services, conduct analytics, maintain security, comply with law, and enforce agreements.

We may disclose the categories of personal information listed above to the categories of recipients described in this Privacy Policy, including customers, authorized users, service providers, subprocessors, integrations, professional advisors, authorities where legally required, and parties involved in business transactions.

HyperRep does not sell personal information.

HyperRep does not knowingly share personal information for cross-context behavioral advertising.

HyperRep does not intentionally collect or use sensitive personal information for the purpose of inferring characteristics about individuals.

17. International Users

HyperRep is based in the United States, and the Services are primarily intended for use in the United States.

If you access the Services from outside the United States, your personal information may be processed in the United States or other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction.

The Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13.
